Terms of Service

1. Eligibility

You must be at least 18 years old to place an order on your own behalf. If you are under 18, an order may be placed on your behalf by a parent or legal guardian who agrees to these Terms.

2. The Service

We capture footage at track and field events and provide edited cinematic clips of athletes who have placed an order. Clip tiers, prices, and descriptions are listed on the Site and may change from time to time. Coverage of any given moment, angle, or athlete depends on what our cameras, drones, and crew were able to capture at the event.

3. Orders, Payment, and Pricing

• Each order is for one (1) event. To order clips for a different event or race, please submit a separate form.
• Payment is processed at checkout via Stripe. Prices are shown on the order form and are in U.S. dollars unless otherwise noted.
• You agree to provide accurate and complete information on the order form. Inaccurate information may make it difficult or impossible for us to locate you on tape.

4. Delivery

We aim to deliver clips within 48 hours of the event. Some events may take longer; in most cases, clips are delivered no later than 7 days after the event. Clips are delivered by email to the address you provide on the order form.

5. Refunds

Captured-footage refund. If we are unable to locate suitable footage of you for your selected tier, we will issue a full refund for that tier. This applies to all tiers, including Epic Moment and Best Attempt.

Quick-pick tiers. "Any Clip" and "Your Attempt" are budget tiers where we deliver the strongest clip we found, as-is. We do not provide refunds or re-edits based on personal preference for these tiers. If you want a specific moment or angle, please choose a higher tier.

Highlights Package. For Highlights Package orders, we will work with you to deliver a reel that reflects your day. If we cannot produce a reel due to insufficient footage, we will issue a full or partial refund at our discretion.

6. License and Usage Rights

Your license. Upon delivery and full payment, we grant you a non-exclusive, worldwide, perpetual license to view, share, and use your delivered clip for personal, non-commercial purposes, including social media use.

Our rights. We retain ownership of all underlying footage, edits, and final clips. Subject to our agreements with event organizers, host institutions, or broadcast partners, and to the rules of any applicable governing athletic body (such as the NCAA, NFHS, or similar association), we retain the right to use footage captured at events, including footage that includes you, for our own portfolio, marketing, demonstration reels, and similar promotional purposes.

Commercial use. If you wish to use a clip for commercial purposes (including paid endorsements, athletic recruiting services, or sponsorships), please contact us to discuss licensing.

7. Filming at Events

We film at track and field meets under agreements with meet organizers, host institutions, or broadcast partners. Our right to capture, retain, and sell or commercialize clips from any given event depends on the terms of our agreement for that event and on the rules of any applicable governing athletic body (including the NCAA, NFHS, or similar association). Some events permit the sale of individual clips; others do not. We make this determination on an event-by-event basis and reserve the right to decline or refund orders for events where commercial sale is not permitted.

Athletes, spectators, and others present at the event may appear in our footage. If you would like to request removal of identifiable footage of yourself from our promotional materials, please contact us at go@racedayclips.com.

8. Donation Commitment

We donate a portion of net proceeds from clips ordered at a given event to that host school's athletic program (or a comparable beneficiary). The form, timing, and recipient of donations are determined at our discretion.

9. User Conduct

You agree not to:

• Submit false, misleading, or fraudulent information;
• Use the Service for any unlawful purpose;
• Attempt to interfere with or disrupt the Site or Service;
• Resell, sublicense, or commercially exploit a delivered clip without a separate written license.

10. Intellectual Property

All Site content — including logos, text, designs, photographs, and code — is owned by Ethereal Lens Media or our licensors and is protected by copyright, trademark, and other laws. You may not copy, modify, or distribute Site content except as expressly permitted.

11. Third-Party Services

The Service relies on third parties including Stripe (payments), Formspree (form processing), and cloud storage providers. Your use of these services through Race Day Clips is also subject to their respective terms and policies. We are not responsible for the acts or omissions of these third parties.

12. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT WE WILL CAPTURE OR DELIVER ANY SPECIFIC MOMENT.

13. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID US FOR THE ORDER GIVING RISE TO THE CLAIM. WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

14. Indemnification

You agree to indemnify and hold harmless Ethereal Lens Media and its officers, employees, and affiliates from any claims, damages, or expenses (including reasonable attorneys' fees) arising out of your use of the Service, your violation of these Terms, or your violation of any rights of another.

15. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, including for any violation of these Terms.

16. Governing Law

These Terms are governed by the laws of Kansas, without regard to its conflict-of-laws principles. Any dispute arising out of these Terms or the Service shall be brought exclusively in the state or federal courts located in Allen County, Kansas, and you consent to the personal jurisdiction of those courts.

17. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date above indicates when the Terms were most recently revised. Continued use of the Service after a change constitutes acceptance of the updated Terms.
